Terms of Service

By accessing or using MenuVivid (menuvivid.com and app.menuvivid.com), you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform.

These Terms constitute a legally binding agreement between you (“the Client”) and Connext Agency (“MenuVivid,” “we,” “us”), a company registered in Morocco. These terms are governed by Moroccan law.

MenuVivid provides the following services:

• Digital QR code menu creation and management
• Augmented Reality (AR) 3D dish visualization
• AI-powered upsell and recommendation engine
• Real-time sales analytics and dashboard
• WhatsApp order notifications
• Multi-language menu support (French, English, Arabic, Spanish)
• Google Reviews integration
• Custom branding and logo support

We reserve the right to add, modify, or discontinue features with reasonable notice.

To use MenuVivid, you must create an account with accurate and complete information.

• You must be at least 18 years old or the legal age of majority in your jurisdiction
• You are responsible for maintaining the security of your account credentials
• You must not share login credentials with unauthorized individuals
• You must promptly notify us of any unauthorized access at contact@menuvivid.com
• One account per restaurant location unless on an Enterprise plan

MenuVivid offers the following plans:

• Starter Plan — includes QR menus, menu builder, multilingual support, and basic analytics. 14-day free trial included.
• Pro Plan — all Starter features plus 3D AR dishes, AI-powered upselling, advanced analytics, and priority support.
• Enterprise Plan — custom-priced for multi-location restaurant groups with dedicated onboarding and SLA.

Prices are displayed in your selected currency (EUR, MAD, USD, GBP, AED, SAR). Annual plans include a discount. All prices are exclusive of applicable taxes unless stated otherwise.

Zero commission on all orders — you keep 100% of your revenue.

Billing terms:

• Subscriptions are billed monthly or annually, auto-renewing until cancelled
• Payments are processed securely by Lemon Squeezy (Merchant of Record) and Stripe
• Failed payment: we will attempt 3 automatic retries over 7 days before suspending the account
• Price changes: 30 days’ advance notice via email for existing subscribers
• Taxes: applicable VAT or local taxes are added at checkout based on your location

Refund policy:

• 14-day money-back guarantee on the first payment of Starter and Pro plans
• Annual plans: pro-rated refund within the first 30 days if unsatisfied
• No refunds after the applicable refund period
• Refund requests: contact@menuvivid.com

You agree NOT to:

• Use MenuVivid for any unlawful purpose or in violation of any applicable law
• Upload false, misleading, offensive, or defamatory menu content
• Share account credentials with unauthorized third parties
• Attempt to reverse-engineer, decompile, or copy our software
• Use automated tools to scrape, crawl, or extract data from the platform
• Attempt to breach, test, or circumvent security systems
• Resell or sublicense MenuVivid services without written authorization

Violation of these terms may result in immediate account suspension or termination.

Regarding content you upload to MenuVivid:

• You retain full ownership of all menu content, images, and branding you upload
• You grant MenuVivid a non-exclusive, worldwide license to display your content to end users (restaurant customers) as part of the service
• You are solely responsible for the accuracy of menu items, pricing, descriptions, and allergen information
• MenuVivid is not liable for incorrect or outdated menu information displayed to your customers
• You warrant that you have the right to use all content you upload and that it does not infringe on any third-party intellectual property rights

All MenuVivid software, technology, design, logos, trademarks, and content (“MenuVivid,” “VIVID”) are the exclusive property of Connext Agency and are protected by Moroccan and international intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our platform or included software without explicit written permission.

• Target uptime: 99.9% monthly availability
• Scheduled maintenance: performed during off-peak hours with advance notice when possible
• We are not liable for temporary downtime due to maintenance, third-party service outages, or force majeure events
• If uptime falls below 99.5% in a calendar month, affected users may request a pro-rated service credit for the downtime period

• You may cancel your subscription at any time via your dashboard — access continues until the end of the current billing period
• MenuVivid may suspend or terminate accounts for Terms violations with written notice
• Upon termination, you may request a data export within 30 days
• After 30 days post-termination, your data will be permanently deleted in accordance with our Privacy Policy
• Outstanding fees remain due even after termination

To the maximum extent permitted by law:

• MenuVivid’s total liability is limited to the fees you paid in the 3 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for lost revenue, lost profits, or business interruption arising from use of or inability to use the service
• We provide the service “as is” with no warranties beyond what is expressly stated in these Terms

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

These Terms are governed by and construed in accordance with the laws of the Kingdom of Morocco.

In the event of a dispute:

• Both parties agree to first attempt amicable resolution within 30 days of written notice
• If unresolved, disputes shall be submitted to the competent commercial courts of Casablanca, Morocco
• EU users retain the right to invoke GDPR-related remedies in their local jurisdiction where applicable
• Nothing in these Terms limits your statutory consumer rights under applicable local law

We may update these Terms from time to time. Material changes will be communicated via email to account holders at least 30 days in advance. The updated Terms will be posted on this page with a new effective date.

Continued use of MenuVivid after the effective date of updated Terms constitutes your acceptance.
